Exclamation Help! Insurance Claim, Paint Problems...

I need some advice help. My car was hit not too long ago on the freeway by some Ford Explorer.. rear end damage. The lady's insurance company is covering everything. They work with "Marcos Auto Body" in San Gabriel which is highly recommended by other forum members so I took it there. They seem very professional.

Today I get a call, they tell me, if I'm aware my car doesn't have OEM paint on it. I sort of knew, when I got the car, because you can tell underhood etc, that it's Sherwood Green OEM color, and was painted over with with white paint. Doesn't look like high quality paint but its been working for the 2 years on it so far.

Well the body shop tells me, if they paint the new bumper, they can't match the paint to it using their paints. And...on the side body panel they can't paint it period because their paint wont "stick" to the body due to the other paint?

They basically want to ask allstate if they can release it in primer to me, and give me like $200-300 to take it to a shop that will do the same kind of paint to it. (I'm guessing cheaper paint).

?? I asked if they could paint the whole car and they said Allstate wouldn't allow that. Sooo...How's this my fault though? My car was in a previous condition that was good, and they can't restore it to that condition? 200-300?? Sounds like to little to me...

I'm starting to wonder if I can just ask allstate how much the original estimate of repairs was (including paintjob) and then just have them cut me a check and take it to whereever i want.

i'm afraid the shop is trying to get a portion of this $$$ now that they know they can't do much to it..

Seems to me that if painting the whole car would do the job then that's what you should get. 2-300 bucks will not get you much in car painting. I would balk at that.

You got a lawyer friend or one that will advise you on your options.

You didn't say what year car you have.

The insurance company is trying to shaft you. Your car should be restored to it's original condition by whatever means necessary. You can't be nice in this situation, her insurance company wants to give you as little money as possible. You need to drop the hammer and start negotiating/arguing/screaming at her insurance company. Don't let up, even after multiple offers of increasing amounts, and they will probably try harder and harder to make you happy. If you can't get enough to get the car fixed in the end of it, just ask for them to cut you a check and decide what you want to do from there.

I agree with alexc. I was in an accident this winter and it was a substantial ammount. The total was $4,000 damage. The body shop had my car for 3 weeks it sucked. The insurance adjuster was an f-ing @$$ hole also. He never answered any of my calles or returned them either. I had to talk to his boss about it. You have to be an @$$hole back to him. Be demanding that your car is fixed proper. Do not let these guys try to take advantage of you !!! If they can they will.
