If the estimate goes over 3k to have it fixed then it will probably be totaled.

A new rear bumper painted will cost you around 500-1000, depending if its new or refurb. Tail light another 100-200, body work looks like 1000-1700. Better hope that rear quarter panel didnt sustain damage. Thats going to cost alot to repair.

Try and get as many parts yourself and have the body shop reimburse you. At least the tail light can be had for 30 bucks on ebay.

Why is it that everyone believes a car is totalled for less than half of NADA/KBB value when the accident "Isn't His Fault"?

If it was his fault, I would agree because his Collision/comprehensive would be covering it and when you are dealing with your own insurance company you don't have the same weight, unless you plan on changing insurance companies and hire an attorney.

When someone else is at fault, and the person wants to keep the car, they can "FORCE" a lot of repairs.

For example: 1985 RX-7 - Damaged $6,700 - Value at time $6,600 (or so) by NADA - Forced repair no salvage title insurance company paid I was not at fault.

This is just one example. My Father-in-law had another similar situation where he forced them to repair the vehicle when "He was not at fault".

Plus, NADA Middle value is almost $5,000 with High being almost $6,000. Let alone KBB which books it even higher in most areas.

And you have to take into account two other things:

1.) The insurance company should pay him "Replacement" value, if they don't he needs an attorney. This could mean a figure of $8,000 depending on what it could be replaced for locally.

2.) An insurance company would much rather spend $3,500.00 than spend $6,000.00. So, if he specifically states he wants it repaired, realistically the insurance company shouldn't complain.

In CA anywhere between 70-80% of the cars high book value is considered a total loss. There could be other factors in there as to why it wouldnt be, but generally its how it goes regardless of fault.

Every insurance company is different, but its to close to call for me.

I pay based on 15k coverage and 2k miles annually, so there would have to be 12-13k worth of damage to total me out.

Litigation is the name of the game, especially if its not your fault. But if the repair bill is way over the the high book worth, you would be better off taking the high cash or a bit higher.
