Court appearence coming up (Non-traffic aka Criminal)

I don't think anyone knows, but I've had a somewhat serious case on my head since '06, and I go to court on thursday.....

I won't go into details unless anyone cares, (uber-long story) but my lawyer seems to think I can beat it. There is a motion to dismiss coming up this Thursday (3/20) and I'm starting to get REALLY anxious....

I didn't get to sleep until 8:30 AM Sunday morning on Saturday (that's worded horribly, but I think ya'll know what I mean) and I think my accute insomnia is kicking in (stress is a factor)...

I'm sure I don't have much to worry about, but fuck, a criminal case is a criminal case-there's always a possibility I could go to jail.

So if I don't post after Thursday, see ya in 2 to 5!!!

This is long. I'll do my best to be concise...

I have a good friend who is a paraplegic (paralyzed) who was forced to move back with his family after his accident. He had moved to Colorado to get away, but had no real choice after it happened.

Well since he moved back, his family has really just been COMPLETELY FUCKED. I don't want to get into a lot of examples, but basically his house turned into a meth house in the span of like 2 months. I'm not hip to all that meth jazz, but I would continue to go over there to see my boy. No one came to visit him after a while, and I mean he was a good friend. I always stayed clean and out of trouble, so I figured I wouldn't have a problem...

Fast forward to April '06. I had gotten his XBOX to fix for him, and I needed to take it back. I go to his house, drop it off and leave. Well, apparently police were watching the house as a drug house, and pulled me over immediately after I left.

A friend that was with me had some pills on him, and when we got pulled over the cops searched him and found em. This is where the story gets FUCKED UP...

The cops basically tel us we're leaving a drug house, and drugs in our posession, but we can stay out of jail. they convince my friend to take him to his house and he'll give them the rest of the pills he has there. So they take him home, he gives em up, and then they tell him 'We found too much shit here, we will have to file charges with the DA. We can help ou out though if you get us some names and/or arrests". Hmmmmmm.....

Fast-forward again to a month later (June '06) and I go back to my paralyzed friend's house (WORST. DECISION. EVER.) and get pulled over again leaving his house. This time, however, I had a traffic warrant for a ticket that I didn't finish off paying.

The cop searches my car & me and finds nothing. He takes me downtown on my traffic warrant, but before I go to majistrate I run into the same detectives that harassed me a month before.

They basically told me the same thing they told my buddy. 'We can make this go away if you get us some arrests/set up drug deals'.
"I don't know what to tell ya. I don't roll like that. Do I look like Im a meth user? I'm like 240 pounds!"

Anyway, I get booked on my warrant and released in like 4 hours.

Fast-forward again to July '07 - and the cops come arrest me at my house. WTF??!?!?!

The cops apparently created evidence and created a phantom posession charge after I didn't co-operate with their snitch-plan.

My friend who originally got busted with pills (and I suspect the pills they claim I had are actually the ones they pulled from his house. ILLEGALLY) has already been on porbation & gotten off while my case is still pending....

Even more jacked up, this was all a sealed indictment releated to the investigation on the drug house. There is no telling how many other people may have gotten screwed, or if the cops were on the "up & up"

Yeah, I would agree. These particular officers are part of 'R.O.P' (Repeat Offenders Program aka 'Rope Officers') and operate a lot like the Texas rangers (without much oversight, and unlimited jurisdiction)...

It's a fucked situation from all sides.....

Yeah I hear the DEA is known for plants. as in planting folks with evidence... if anything make sure your lawyer makes them prove you had the drugs.

Thank GOD that this isn't a DEA related case (Federal). This isn't even a state investigation, it's county based....

Yeah this whole thing has really soured me on the police (even moreso than before)

When I was a kid, I was a total knockoff and a few runins with cops, and never really respected them. As I grew up, that changed, but since this happened I have a hard time respecting them anymore....

And I fucking HATE to generalize. I rarely use the word 'everybody' or 'all the time' , but this has made it hard for me not to get a bit indignant towards coppas again....

i hate loosing sleep b.c of stress. I didn't sleep much b4 driving to tx over the summer, considering, no license, no insurance, no valid tags. made it back and forth.

hopefully your case gets dismissed. its just pure BS!

Make sure your lawyer is very well versed in cases such as this. I'm assuming he's had quite a bit of time to prepare his case, but I'd be interested in finding out the outcome of the motion for dismissal.

Whatever happens happens. If you know you're innocent, it doesn't matter what they do to you, only what you know in your heart.

Keep your head up!

BTW, I'm assuming it was a misdemeanor posession charge?
