Interesting story again. The possession charge was a class c felony back in '06, but the law was changed to a class a misdemeanor on 1/31/07

My charge is a misdemeanor.

My lawyer is a woman, and teaches law @ St. Mary's here in town (one of the better law schools in the nation) and I have paid her quite a bit to keep this off my record....I have a great deal of confidence she knows what she's doing...

During one of my appearences, when she walked in-she started talking to all of the prosecturs there for other cases, and was joking and laughing with them. Having someone who is friendly-ish to the enemy is a GREAT benefit....

Not considering it's been TWO FUCKING YEARS since this mess happened. If I was really orth prosecuting, wouldn't I have gotten caught up in SOMETHING during that time???

Without having too many details, I would say there was no probable cause to arrest you in the first place. Also, when you guys were in custody, it seems like you were coerced to go back inside the house that you had no authority or possession over anyways. So any permission to enter is invalid. Therefore, all the contraband they found in the house are the fruits of an illegal search. 10 bucks says illegal search and all the drugs inside the house will be kept out on a motion to suppress.

I'm not going to go into a dissertation. Anyways, I don't have enough facts.

I don't know if I explained it wrong, but not quite....

The house they found the "illegal" items in was not the same house me and my friend were leaving. It's totally fucked, but I can sympathize with where my friend came from...

He took them to HIS OWN HOUSE on the other side of town from where we got detained. After the cops told him they would give him a deal, they filed charges on him AFTER they had the drugs in their possession (aka coercion/illegal seizure/entrapment/GOD know what else)....

I didn't get arrested until a moth later, and I did have a valid traffic warrant. I paid that shit off the very next day after I got released...

Thanks for all the support guys. I haven't talked to ANYONE outside of my family about this, and I needed to tell the story at least once....

Good luck my G. Police 85% of the time will try to get u down. I rarely run n2 police who really want 2 help u. I would've gotten that shit in writing about going to ur friends house and getting off from the prior chrg.
