i got another ticket
i'm an idiot i know
but there were like no cars around and it was just a huge open stretch of road, anyways, i got clocked doing 89 in a 45. this is my second ticket, my first one was 82 in a 65, i got it in the same town (i'm in virginia for college but i'm a resident of maryland). for that first ticket, i had to go to court and basically they just lowered my fine from 150 to 100. i thought that it would add points to my record and make my insurance go up, but my maryland insurance hasn't said a word about it and that was over 2 years ago. i heard that some states don't have to punish their residents if they speed in another state. i'm not sure if maryland does that, but either way, my insurance hasn't gone up (not sure even if i have points on my record). anyways, for this second ticket i just got, i once again have to go to court. the officer said the maximum penalty is one year in prison, but he said that usually it doesn't result in that. i'm worried though, they said another guy was caught going 105 and had to go to jail for 30 days. do judges look at 89 and think it's less bad than 105 by much? i'm currently a college student doing summer school, i hope that helps in me not having to go to jail. at this point, i'd rather just pay the fine and forget all about this ever happening. do you guys think i should hire a lawyer? how much would one cost for an offense like this? argh this is really nerv racking, any words of advice would be much appreciated. thanks.

well one thing I can say is that now ALL states have passed some law where the points and tickets do get shared. I used to live in Fairfax, VA and commute to College Park, MD every day. I got two tickets in MD on I-495 in one year and although I cant remember how long it took.....I ended up getting a warning from VA saying that my points were close to suspension. By the way, this was back in 2001.....so I think your tickets will show up. Maybe you got lucky or something....but I'd bet 12 cents that if you check your record, it's on there.
As far as courts go....I had a cousin who was doing 110 in a 65 (on Interstate 64 in VA) and he DID get 30 days in jail....I was pretty young so I dont remember all the details, but I DO REMEMBER THIS: my mom told me the story and said that my cousin NEVER told his parents for the obvious reasons and he went to court himself......boom, he got jail time. Now I dont know what all was said in court, what he tried to say etc....but I do know that my cousin at the time and now....is very clean cut and was also IN COLLEGE. Now I also dont know what his driving record was like (although this was the only grape vine story I ever heard from my mom), so take this all with a grain of salt. Especially since it's summer time....maybe consider voluntarily giving up your license for six months. Cant remember the exact details, but your points get reduced or taken away.....talk with your lawyer. And if anything, a lot of lawyers give free consults over the phone. USE THEM!!!!! |

and here's that law
The Nonresident Violator Compact assures nonresident motorists in member states they'll receive the same treatment as resident motorists. When drivers receive traffic citations in member states, they must fulfill the terms of that citation or face the possibility of license suspension in their home state until they meet those terms. Nonresident drivers have due process protection and cannot be detained out of state. Currently, 44 states and the District of Columbia are members of the compact. Alaska, California, Michigan, Montana, Oregon and Wisconsin are nonmembers. The compact doesn't apply to parking or standing violations. Highway weight limit violations and violations of Hazmat transportation laws.
The National Driver License Compact exchanges violation information with other states and the District of Columbia. Out-of-state violations become part of your NJ driving record. Georgia, Massachusetts, Michigan, Tennessee and Wisconsin are nonmember states. I got this from some guy who was asking about his NJ record......it looks like there are two laws...the first one says if you dont pay your VA ticket, MD will be able to suspend your license. The 2nd law looks like if you get VA tickets, they go on your MD record. And unfortunately......VA and MD are both members in both the Nonresident Violator Compact and the National Driver License Compact.....so they'll show up at some point. Maybe since you're in school and possibly still with your parent's plan....it didnt effect your insurance rates yet. When I was in college, my parents' insurance kicked me off their plan b/c I had too many tickets. |

one last thing
and you should check with MD on this, but certain states will NOT allow you to go to driving school in response to an out of state ticket. I know driving school only takes off two points....but just in case you were thinking this would help afterwords....check with your state first.
Here are a couple other things I found (yea I'm bored) that should point you RIGHT TO THAT YELLOW PAGE BOOK: I was coming back from my vacation from myrtle beach and as I was driving along 95 in southern VA I got a ticket. It was for reckless driving by speed 91 in a 65 (yea i know stupid right). So my question is this, does anyone know for sure if points transfer to maryland or not, and also is this a mandatory court apperance, as I live almost 5 hours away and starting a new job this would be almost impossible to meet the sept 2 court date they already gave me(in maryland we have to wait for them to mail it). Thanks in advance some responses: As a former VA resident, I must inform you that you are in serious trouble with that ticket. Speeds over 90 MPH can result in license suspension and possible jail time. Reckless driving is a Class 1 Misdemeanor in VA...in other words, a criminal offense that carries a fine of up to $2500 and up to 1 year in jail (though you'll likely get just a fine of a few hundred $$$). You live in MD, so the MD DMV rules should apply as far as your license is concerned, but the offense in VA definitely will show up on your MD driving record and will wreak havoc with your auto insurance...your rates will go through the roof with a reckless driving conviction on your record. Generally, you DO have to appear in court for a reckless driving ticket in VA. I strongly suggest you get a lawyer right away and discuss your options. I wish I had better news, dude, but that's the reality of your situation... :crap: Good Luck... Hire a lawyer, ASAP. Get one that is buddy buddy with all the judges and prosecutors down there. Wreckless is no joke in VA. You'll actually have a criminal record, and it stays on your driving record for 12 years. DO ANYTHING AND EVERYTHING TO GET IT REDUCED TO IMPROPER DRIVING!! as he said exactly. VA has no real crime what so ever so when you speed that a crime. you are in deep trouble VA is known to be F state when it comes to speeding you can even get away with red light but once they get you speeding you are having a ticket my friend. if you were here in CA it would have been a different stroy as i pass cops and tropers on the free way every day doing over 90 lol with my big wing on the back. hey at least you werent doing 90MPH or more. You didnt say so for sure but when you said the officer said maximum of a year....that sounds like Reckless Driving. Get a lawyer, good luck with everything, and let us know how it went! hey thanks for the very informative replies, it really cleared up some stuff. i don't know about my first ticket (it was in 2002), but my insuarnce def. hasn't gone up because of that. now this being my second reckless ticket, my ticket says "reckless driving by speed 89/45 MPH zone". i hear that going over 90 is a big no no, so i guess i'm damn lucky i was going 89.
i'm gonna hire a lawyer and talk about this with him, but what do you think he can really do for me? i don't want to spend any days in jail, i'd rather just pay a fine and maybe have a suspended license for a few months. i really hope that the 89 MPH is a safe zone from jail. plus, i'm a college student enrolled in summer school right now, i can't afford to fail this class.

I got out of a ticket today. I was going 45 in a 35, got pulled over, officer asked me where I was heading. I tild him I was going to work, he asked where I worked, I told where I worked. He went back to the car and came back a few minutes later and told me to slow down.

well from looking at other people's posts on the web about beating tickets....they all seem to say that if you have a reckless ticket, do everything you can to plea down to improper driving or speeding 20+......and I think that having a lawyer might help......especially A LAWYER FROM THAT COUNTY. All these courts have the same prosecutors / laywers / judges and they get used to each other. Find one that specializes in traffic and is in that city....he'll know the judge, the prosecutor and he'll be able to work out a better deal then you would. You never know....you might walk in alone and the prosecutor wants to make an example of you....vs. you walk in with a lawyer, the two lawyers know each other, your lawyer says "hey this is a good kid in college, let's cut him a break" and you pay a reduced fine.

I never got a speeding ticket before and i go 85 cruise control on the freeway interstate 80 in california. Sometimes the police would go 80 in front of me while i follow at the same speed. Just follow the speed of traffic?? However, my little brother in his civic has gotten a ticket because the cop thought his muffler was too loud with the silencer permanently soldered to it. It was actually not loud at all. He also got a ticket while going 96 on a 65 zone. The ticket was over 300 dollars and the point was not correctable by going to driving school. This is in California though, anyways, i dont think you will need to go to jail. good luck

no prayer before judgement? or that only applicable for first time offenses? i would have done that for my first ticket in NC, but my lawyer got it knocked down to a nonmoving violation however if i got another speeding ticket within a year of receiving my first, both tickets would show up on my insurance and id get 2 points for reckless driving (60 in a 45 was what got me pulled over the first time)

well this is my SECOND ticket, it's a reckless. my first ticket was 82 in a 65, but that was in 2002 (over 2 years ago). i have an arraignment date next wednesday, i need to find a good lawyer by then.
