Right now I am using 10W40 in my legend. its pretty hot here in PA. is it a good idea to stick with 10W40 or should I use something tinner like 10W30.

My legend does have high mileage and ticks just a little bit. but it gets better with more frequent oil changes.

what do you guys think on the oil. btw i use the $1 a quart mobil.

Here's a general rule of thumb:

Winter Time = Thinner Oil (i.e. 5W-30/40/50)
Summer Time = Thicker Oil (i.e. 20W-50/40/30)

10W-40 is probably the most versatile in the temperature range, if memory serves correctly, 10W-40 can handle the stress of both winter and summer.

You should be all right. If you notice any increase in temperature and assuming the cooling system (radiator, fluid, and water pump are ok, no cracks in the head/engine, no head gasket leak), you can switch to a thicker oil to see if that'll cool it down. The thicker oil, because it is thicker, it will provide an extra layer of thickness between the 2 rubbing metals.
